In this article I argue that Levinas can be read as a critic, not just of Heideggerian being, but also of being-with. After pointing out that the publication of the Black Notebooks only makes this criticism more interesting to revisit, I first of all discuss passages from both earlier and later writings in which Levinas explicitly takes issue with Heidegger’s claim that there is no self outside of a specific socio-historical community. I then explain how these criticisms are reflected (...) in Levinas’s own account, arguing that Levinasian subjectivity and alterity are precisely defined by their not belonging to a larger unity; to the extent that they partake in a multi-personal collectivity, this does not take the form of a traditional community. In the final section, I look into a different and seemingly opposing argument Levinas makes against Heidegger: on the basis of the latter’s reflections on death, he argues that Dasein is anti-social rather than overly immersed in the socio-historical. Arguing that this rests on a misreading of Being and Time, I use this opportunity to raise questions about Levinas’s interpretation of Heidegger and his “otherwise than being-with” more generally, for Levinas’s account runs into several problems as well. Yet as I will conclude, this in fact offers a valuable insight, not just for the present-day reception of Heidegger, but also for thinking community today. It indicates that a radical break with human situatedness does not automatically fare better than a firmly enrooted account of existence. (shrink)

Localization Wireless Sensor Networks (WSN) represent a research topic with increasing interest due to their numerous applications. However, the viability of these systems is compromised by the attained localization uncertainties once implemented, since the network performance is highly dependent on the sensors location. The Node Location Problem (NLP) aims to obtain the optimal distribution of sensors for a particular environment, a problem already categorized as NP-Hard. Furthermore, localization WSN usually perform a sensor selection for determining which nodes are to be (...) utilized for maximizing the achieved accuracy. This problem, defined as the Sensor Selection Problem (SSP), has also been categorized as NP-Hard. While different metaheuristics have been proposed for attaining a near optimal solution in both problems, no approach has considered the two problems simultaneously, thus resulting in suboptimal solutions since the SSP is biased by the actual node distribution once deployed. In this paper, a combined approach of both problems simultaneously is proposed, thus considering the SSP within the NLP. Furthermore, a novel metaheuristic combining the Black Widow Optimization (BWO) algorithm and the Variable Neighbourhood Descent Chains (VND-Chains) local search, denominated as BWO-VND-Chains, is particularly devised for the first time in the author’s best knowledge for the NLP, resulting in a more efficient and robust optimization technique. Finally, a comparison of different metaheuristic algorithms is proposed over an actual urban scenario, considering different sensor selection criteria in order to attain the best methodology and selection technique. Results show that the newly devised algorithm with the SSP criteria optimization achieves mean localization uncertainties up to 19.66 % lower than traditional methodologies. (shrink)

From the theory of ‘deliberative democracy’ to the politics of the ‘third way’, the present Zeitgeist is characterized by attempts to deny what Chantal Mouffe contends is the inherently conflictual nature of democratic politics. Far from being signs of progress, such ideas constitute a serious threat to democratic institutions. Taking issue with John Rawls and Jürgen Habermas on one side, and the political tenets of Blair, Clinton and Schröder on the other, Mouffe brings to the fore the paradoxical nature (...) of modern liberal democracy in which the category of the ‘adversary’ plays a central role. She draws on the work of Wittgenstein, Derrida, and the provocative theses of Carl Schmitt, to propose a new understanding of democracy which acknowledges the ineradicability of antagonism in its workings. Chantal Mouffe is one of the most influential political theorists at work today. Her work has influenced political parties across Europe and continues to inform the direction of left politics. In this work, Mouffe argues that liberal democracy misunderstands the problems of ethnic, religious and nationalist conflicts because of its inadequate conception of politics.

The decades following the civil rights and decolonization movements of the sixties and seventies - termed the post-soul era - created new ways to understand the aesthetics of global racial representation. Daphne Lamothe shows that beginning around 1980 and continuing to the present day, Black literature, art, and music resisted the pull of singular and universal notions of racial identity. Developing the idea of 'Black aesthetic time' - a multipronged theoretical concept that analyzes the ways race and time (...) collide in the process of cultural production - she assesses Black fiction, poetry, and visual and musical texts by Paule Marshall, Zadie Smith, Tracy K. Smith, Dionne Brand, Toyin Ojih Odutola, and Stromae, among others. Lamothe asks how our understanding of Blackness might expand upon viewing racial representation without borders - or, to use her concept, from the permeable, supple place of Black aesthetic time. Lamothe purposefully focuses on texts told from the vantage point of immigrants, migrants, and city dwellers to conceptualize Blackness as a global phenomenon without assuming the universality or homogeneity of racialized experience. In this new way to analyze Black global art, Lamothe foregrounds migratory subjects poised on thresholds between not only old and new worlds, but old and new selves. (shrink)

Dr. Martin Luther King Jr.’s theology and rights-based activism remain highly relevant in a constitutional democracy. However, King’s use of human dignity in his early sermons as an extension of political rights faces serious challenges from Black leftist political writers and the Black Lives Matter movement. At issue is the extent to which human dignity should be examined as a distinct political, aesthetic, and moral category that must be explored and embraced more explicitly and wholeheartedly in Black (...) politics and political theory. Bracketing human dignity inside the category of political rights, which King often did in his early writings, undermines the comprehensive nature of antiblack racism and limits the scope and range of questions and resources we might employ to address the social ontology of Blackness. A sustained attention to human dignity provides an opportunity for new scholarly direction in the study of Black politics and political thought by expanding the boundaries of the political and creating space for morality and Black religion in the political (leftist) imaginary. A recent commentary defends 1) the concept of 'brain arrest' to explain what brain death is, and 2) the concept that death occurs at 2–5 minutes after absent circulation. I suggest that both these claims are flawed. Brain arrest is said to threaten life, and lead to death by causing a secondary respiratory then cardiac arrest. It is further claimed that ventilation only interrupts this way that brain arrest leads to death. These statements imply that brain arrest is not death (...) itself. Brain death is a devastating state that leads to death when intensive care, which replaces some of the brain's vital functions such as breathing, is withdrawn and circulation stops resulting in irreversible loss of integration of the organism. Circulatory death is said to occur at 2–5 minutes after absent circulation because, in the context of DCD, the intent is to not attempt reversal of the absent circulation. No defense of this weak construal of irreversible loss of circulation is given. This means that paents in identical physiologic states are dead (in the DCD context) or alive (in the resuscitation context); the current state of death (at 2–5 minutes) is contingent on a future event (whether there will be resuscitation) suggesting backward causation; and the commonly used meaning of irreversible as 'not capable of being reversed' is abandoned. The literature supporting the claim that autoresuscitation does not occur in the context of no cardiopulmonary resuscitation is shown to be very limited. Several cases of autoresuscitation are summarized, suggesting that the claim that these cases are not applicable to the current debate may be premature. I suggest that brain dead and DCD donors are not dead; whether organs can be harvested before death from these patients whose prognosis is death should be debated urgently. (shrink)

Cross-border reproductive care (CBRC) can be defined as the movement from one jurisdiction to another for medically assisted reproduction (MAR). CBRC raises many ethical concerns that have been addressed extensively. However, the conclusions are still based on scarce evidence even considering the global scale of CBRC. Empirical ethics appears as a way to foster this ethical reflection on CBRC while attuning it with the experiences of its main actors. To better understand the ‘in and out’ situation of CBRC in Canada, (...) we conducted an ethnographic study taking a ‘critically applied ethics’ approach. This article presents a part of the findings of this research, obtained by data triangulation from qualitative analysis of pertinent literature, participant observation in two Canadian fertility clinics and 40 semidirected interviews. Based on participants’ perceptions, four themes emerged: (1) inconsistencies of the Canadian legal framework; (2) autonomy and the necessity to resort to CBRC; (3) safety and the management of CBRC individual risks; and (4) justice and solidarity. The interaction between these four themes highlights the problematic of ‘reproductive outsourcing’ that characterised the Canadian situation, a system where the controversial aspects of MAR are knowingly pushed outside the borders. The surge of the conquest of black African women grows rapidly as indicated by the multifaceted oppressions experienced by black African women today. Although coloniality is supposed to be a thing of the past, its stench still wreaks havoc for the present-day black African woman whose reality of experience is that of 'triple pain' (Vellem 2017). Colluding with the church, colonisers reinforced and justified the centralisation of the west in Africa, which was established through violence and consequently (...) led to the conquest of black humanity. However, womanism has argued that it was black African women who, in addition to being conquered based on their race, were rigorously subjected to patriarchal violence. Today, the church has a prominent role in the lives of many black African women; thus the church has an integral responsibility of pursuing liberation of black African women and ultimately all humanity (Kobo 2018). Nevertheless, the church cannot move towards liberation without critiquing the toxic relationship between church and coloniality and its legacy of the conquest of black African women through patriarchal violence. Undoubtedly, many black African women continue to experience patriarchal violence to this day, and the church has many a time become the source of their suffering. This calls for a serious engagement within the liberation discourse to uproot colonial legacy of the conquest of black African women. CONTRIBUTION: The purpose of this article is to explore the relationship between the church and coloniality, and how this relationship has impacted the lives of black African women. Employing womanism as the primary framework, this article seeks to offer a womanist critique that seeks to disrupt the collusion of church and coloniality in its legacy of the perpetuation of patriarchal violence which leads to the conquest of many black African women today. African American history resounds with calls for black unity. From abolitionist times through the Black Power movement, it was widely seen as a means of securing a full share of America's promised freedom and equality. Yet today, many believe that black solidarity is unnecessary, irrational, rooted in the illusion of "racial" difference, at odds with the goal of integration, and incompatible with liberal ideals and American democracy. A response to such critics, We Who Are Dark provides the (...) first extended philosophical defense of black political solidarity. Tommie Shelby argues that we can reject a biological idea of race and agree with many criticisms of identity politics yet still view black political solidarity as a needed emancipatory tool. In developing his defense of black solidarity, he draws on the history of black political thought, focusing on the canonical figures of Martin R. Delany and W. E. B. Du Bois, and he urges us to rethink many traditional conceptions of what black unity should entail. In this way, he contributes significantly to the larger effort to re-envision black politics and to modernize the objectives and strategies of black freedom struggles for the post-civil rights era. His book articulates a new African American political philosophy--one that rests firmly on anti-essentialist foundations and, at the same time, urges a commitment to defeating racism, to eliminating racial inequality, and to improving the opportunities of those racialized as "black.". Objective: Contemporary ethical accounts of the patient-provider relationship emphasise respect for patient autonomy and shared decision making. We sought to examine the relative influence of involvement in decisions, confidence and trust in providers, and treatment with respect and dignity on patients’ evaluations of their hospital care.Design: Cross-sectional survey.Setting: Fifty one hospitals in Massachusetts.Participants: Stratified random sample of adults discharged from a medical, surgical, or maternity hospitalisation between January and March, 1998. Twelve thousand six hundred and eighty survey recipients responded.Main outcome (...) measure: Respondent would definitely be willing to recommend the hospital to family and friends.Results: In a logistic regression analysis, treatment with respect and dignity 3.4, 99% confidence interval 2.8 to 4.2) and confidence and trust in providers were more strongly associated with willingness to recommend than having enough involvement in decisions . Courtesy and availability of staff , continuity and transition , attention to physical comfort , and coordination of care were also significantly associated with willingness to recommend.Conclusions: Confidence and trust in providers and treatment with respect and dignity are more closely associated with patients’ overall evaluations of their hospitals than adequate involvement in decisions. These findings challenge a narrow emphasis on patient autonomy and shared decision making, while arguing for increased attention to trust and respect in ethical models of health care. (shrink)

In multiple essays, CLR James lays out what a theory of subjectivity must account for to resolve issues stemming from reducing subjectivity to a singular identity. Most proposals for a theory of subjectivity do so by making the subject the object of another’s propositions or claims about the world. I argue that this is an identity claim. The converse of this process is also true, that the subject who claims another as the object of their proposition must also be the (...) object of a proposition themselves, leaving the capacity to form these expressions untouched. In Black Cultural studies, there has been a lot of attention paid to the capacity for one to become the object of their own propositions due to the conception that Black identity overdetermines Black subjects’ expressions prior to their articulation. Our reorientation to the study of subjectivity posits an entity whose operation functions to mobilise as well as implement identity claims. Subjectivity is a capacity while identity becomes the object of that capacity, an object shared between subjects that are known by becoming the object of propositions regarding the world, including their own. This essay attempts to resolve the conflicts that arise once the mistake of conflating subjectivity with identity claims is made and proposes a model whereby the concept of Black subjectivity can be explained. This article investigates the metaphor of the “black box” in artificial intelligence, a representation that often suggests that AI is an unfathomable power, politically uncontrollable and shrouded in an aura of opacity. While the concept of the “black box” is legitimate and applicable in deep neural networks due to the in- herent complexity of the process, it has also become a generic pretext for the perception, which we seek to critically analyze, that AI systems are inscrutable and out (...) of control, as well as supposedly endowed with intel- ligence and creativity. To challenge these ideas, we will address what we call the supremacy of patterns and the two significant phenomena that result from it: enchanted determinism and the dictatorship of the past. In lieu of an abstract, here is a brief excerpt of the content:BLACK-ON-BLACK VIOLENCE: THE INTRAMEDIATION OF DESIRE AND THE SEARCH FOR A SCAPEGOAT Fred Smith Emory University René Girard's mimetic hypothesis provides a means of interpreting texts in terms of a systematic understanding ofcultural formations such as ritual, prohibition, and myth. It is based on an anthropology which accepts that most cultural texts are generated by an agency that does not appear explicitly or thematically within the texts (...) themselves. That generative agency is the scapegoat mechanism which I will discuss extensively in this essay as it concerns black-on-black violence in American society. With some modification, Girard's ideas account for the effects of the pathogenic educational environment to which black boys are exposed and which results in such violence. What we are witnessing in black-on-black violence may be understood in part as the consequence ofscapegoating which is driven by interdividual dynamics of desire analyzed in Girard's observations of mimetic behavior among humans. Mimetic desire is the starting point ofGirard's theory. Desire is mimetic in the sense that it imitates the desire of another. One's desire copies the other's desire for an object. Such desire is potentially violent because it can and often does lead to the rivalry of desires for the very same object. When mimetic desire is acquisitive, it produces violence at its most fundamental level. It is not that all mimetic desires "produce" violence, only acquisitive desire that becomes rivalrous or conflictual. I. The Triangle of Desire "Mimetic" comes from the same root as "mime" and "imitate." An acquisitive mimetic desire in Girard's theory involves the "desire to have" which imitates another person's desire for the possession or enjoyment ofan Fred Smith33 object. The object of desire may be a person or a thing; it can be a nonmaterial or metaphysical object like prestige, honor or "face" (pride). It is another who serves as the model for desiring a particular object. The greater the model's desire for the object, the greater the mimetic desire it inspires. The results are jealousy and covetousness over the possessions, positions or prestige, desired or enjoyed by the model of our desires. Desire is imitative because it is attracted to the object(s) belonging to another; furthermore, it is activated by the desire ofthe other, who may be a single person or an entire group. This imitative process requires that the subject have access to, or be able to appropriate and dispose of, the model's objects or possessions. Thus desire is triangular in its structure, being comprised ofthe subject, the other as model of desire, and the model's objects. Distance between the subject and model is an important factor in this structure. It does not necessarily denote physical space, for it can also function in terms ofpsychosocial space (i.e., race, socioeconomic position, cultural standing, etc.) (Redekop 7). Not only individuals, but society as a whole can serve as the model of desire. One also learns what is desirable from the aggregate of others that is society (Hamerton-Kelly 3). Acquisitive mimetic desire necessitates the ability of individuals to see themselves in the position ofthe model of desire. Ifthey are not able to see themselves in the place ofthe model, then the potential for the development of mimetic desire is minimal. This is why there is greater rivalry and jealously among slaves than between slave and master; among workers, rivalry is greater than between bosses and workers among siblings it is greater than between parents and children. This is the primary reason why violence is intraracial rather than interracial. II. Internal Mediation of Desire Mimetic desire is often reciprocal. Two people can be models ofdesire for each other, each one imitating the desire of the other for a common object. Acquisitive mimetic desire not only involves a desire to have, but includes the desire to be like, or even to be the other. This is why mimetic desire often evolves into love/hate relationships. This phenomenological research investigates how it is possible to determine the extent to which a chromatic colour appears white and black in order to use it to build a new Colour Rendering Index. We tested two methods of subjective evaluation; in the first, the perceptual presence of white (and black) in a colour alone was assessed on a unipolar intensity scale, independently for the two attributes. In the second method, evaluations of whiteness (and blackness) were conducted for colours (...) presented in a sequence ordered from the least to the greatest presence of the respective attribute. In both tests evaluations were made either by moving an arrow on a slider from left (minimum) to right (maximum) or by choosing a grey cylinder that matched the same degree of similarity to white (and black) as the test colour. In four experiments, 16 colours of 4 hues and 4 different shades were studied; in a fifth experiment, 48 colours, 12 for each quadrant of the colour wheel, were studied; finally, in another test, 10 greys were studied. In the first three experiments, the results were unexpected, as the evaluations of whiteness and blackness were complementary, adding up to 100%, while in the current NCS, 100% includes not only the evaluation of white and black but also that of chromaticness, therefore white and black are not complementary. In the fourth and fifth experiments, the sum of the evaluations of white and black was always less than 100%, in accordance with the present NCS. In the last experiment, the evaluations of white and black given independently to the 10 greys samples were complementary, confirming the bipolar nature of white-black continuum. Suggestions have been provided to resolve the discrepancy between the results of this research and the structure of the current NCS. (shrink)

ABSTRACTThis paper examines Martin Heidegger’s own interpretation of Being and Time in the Black Notebooks. The opening part addresses Heidegger’s singular notions of “thinking” and “questioning” which suggest a critically reflective stance, but involve an initiatory call to surrender to the hidden powers of Beyng. The second part addresses Heidegger’s lament in the Black Notebooks that Being and Time has not produced a “great enemy”, and his critique of the initial existentialist or “anthropological” receptions of his magnum opus. (...) The third part looks at how Heidegger’s thought moves beyond Being and Time, in light of the central role the thinker assigns to the German people in repeating the first “inception” of preSocratic thought, in order to overcome the legacies of Roman universalism, and what Heidegger as early as 1932 was calling “Jewish Christianity”. The final part addresses Heidegger’s conception of “the history of Beyng” as it is developed in the Black Notebooks of the early 1940s, from out of the account of “temporality” in Being and Time: a “history” in which Heidegger’s postulation of a need for the “annihilation“ ” of the essential enemy of the Volk become the lens through which Heidegger can read the Shoah as the “the peak of self-destruction in history”. American Academy of Pediatrics (AAP) and American College of Medical Genetics (ACMG) recently provided two recommendations about predictive genetic testing of children. The Clinical Sequencing Exploratory Research Consortium's Pediatrics Working Group compared these recommendations, focusing on operational and ethical issues specific to decision making for children. Content analysis of the statements addresses two issues: (1) how these recommendations characterize and analyze locus of decision making, as well as the risks and benefits of testing, and (2) whether the guidelines conflict or (...) come to different but compatible conclusions because they consider different testing scenarios. These statements differ in ethically significant ways. AAP/ACMG analyzes risks and benefits using best interests of the child and recommends that, absent ameliorative interventions available during childhood, clinicians should generally decline to order testing. Parents authorize focused tests. ACMG analyzes risks and benefits using the interests of the child and other family members and recommends that sequencing results be examined for additional variants that can lead to ameliorative interventions, regardless of age, which laboratories should report to clinicians who should contextualize the results. Parents must accept additional analysis. The ethical arguments in these statements appear to be in tension with each other. (shrink)

It is often believed that attentional bias for food is a stable trait of certain groups, like restrained eaters. However, empirical evidence from this domain is inconsistent. High-calorie foods are double-faceted, as they are both a source of reward and of weight/health concern. Their meaning might depend on the food-related context, which in turn could affect AB for food. This study primed 85 females with hedonic, healthy, and neutral contexts successively and examined whether food-related context affected AB for food and (...) if effects were moderated by dietary restraint. Both the mean tendencies of AB for food and variability of AB for food were assessed in a food dot-probe task with a recording of both reaction times and eye movements. Contrary to our hypotheses, AB for food was not significantly affected by either context or the interaction between context and dietary restraint. Instead, liking of the presented food stimuli was related to longer initial fixations and longer dwell time on the food stimuli. In addition, in line with prior research, body mass index was correlated with variability of AB for food instead of mean AB for food. In conclusion, this study did not find any support that AB for food is dependent on food-related context, but interestingly, reaction time-based variability of AB for food seems to relate to BMI, and eye movement-based mean AB seems to relate to appetitive motivation. Survivors of the Black Death confronted a world changed very much for the worse, or so we often say when ignoring nuance. There is no denying that many chroniclers wrote from a situation of real anxiety about an uncertain future. Many locales felt the effects of severe wage inflation and dramatic price fluctuations, some work regimes intensified, social mobility increased, and the utility of traditional safety nets failed to provide against localized food scarcity. Nevertheless, we should view with caution (...) descriptions of plague-induced economic and social dislocation leading to anarchy and decadence, which can become colorful exaggerations, especially when buboes and piled bodies get added to the narrative mix. In recent years many researchers have begun to confront the overload of stereotypes about postplague living to which a human inclination to prurience and some vast historical lacunae have led us. Edwin Hunt, James Murray, and others have found men and women in late-medieval Europe seizing latent economic opportunities in the midst of their difficult circumstances, stimulating producer innovations and encouraging a consumption boom. The medical practitioners studied by Jon Arrizabalaga and John Henderson did not surrender to the defeatism often ascribed to them. And despite the evidence that social stress made room for extremism—flagellant self-abuse, attacks upon Jewish communities, urban riots and rebellions—in government and the world of custom pragmatic flexibility insulated foundational institutions against radical upheaval. Important continuities bridged the pre- and postplague eras. Plague epidemiology has also grown more complex in response to a keener understanding of the morphology of disease agents and the historical shaping of disease categories. (shrink)

Medical research is widely thought to have a fundamentally therapeutic orientation, in spite of the fact that clinical research is thought to be ethically distinct from medical care. We need an entirely new conception of clinical research ethics—one that looks to science instead of the doctor‐patient relationship.

Revisiting the generally accepted notion of psycho-physical parallelism in Spinoza, Chantal Jaquet offers a new analysis of the relation between body and mind. Looking at a range of Spinoza's texts, and using an original methodology, she analyses their unity in action through affects, actions and passions.

Desde una perspectiva posfundacional, la política no puede reducirse a una región de lo social, ya que lo político, como momento de activación, es ubicuo, desterritorializado y emerge de forma contingente. Esto abre las puertas a percibir el surgimiento de lo político en cualquier espacio, independientemente de si permanece o no dentro del terreno institucional de la política. Chantal Mouffe ha desarrollado en algunos de sus escritos la relación entre arte y política desde esta perspectiva, cuestión que suele pasar (...) inadvertida pero que resulta de vital interés para el campo de los estudios sociales del arte. Asimismo, su propuesta de arte político se ubica en la antítesis de muchos trabajos y análisis de casos que, desde las ciencias sociales y estudios del arte, han abordado la politicidad del arte centrados en una relación directa entre la producción artística y la temática a la que refiere la obra. En este sentido, sostenemos que la politicidad no se reduce a la temática de las prácticas artísticas sino que tiene relación con el sujeto productor, el modo de producción de la obra (individual o colectivo) y de intervención; producción en lo social, especialmente en el espacio. Estas cuestiones, como ya veremos, aparecen desarrolladas de manera muy interesante en algunos escritos de Chantal Mouffe. De este modo, en este artículo, a la par que nos proponemos presentar su propuesta de análisis para las prácticas artísticas, produciremos reflexiones y análisis de diversas producciones artísticas, con el fin de mostrar tanto la utilidad de la teoría resituada en estas latitudes como sus flaquezas. Scientific knowledge is no longer transmitted solely through a one-way channel of communication from scientific communities to `lay' readers through the knowledge transmission `chain'. Communication between the two communities has now been extended into media and everyday social discourse where it crops up in news debates about issues such as public health and food safety. In this process, scientific academic discourse has lost much of its original form. This article examines part of the current research at the Centre de recherche (...) sur les discours ordinaires et spécialisés. It provides evidence of new discursive forms adopted by science in media and social discourse, such as the emergence of enunciative standpoints, the redefinition of the role of the journalist as mediator between science and the general public, the use of specific forms of intertextuality and the interweaving of scientific elements in general social discussions. This research on new data implies renewed definitions of certain concepts used in linguistic descriptions: discursive meaning and signification, interdiscursive memory bank, etc. These recent forms of discourse have brought about a change in the status of science so that science has now become an object of debate in the public arena — a sign of its crucial social role. Brain death has been accepted worldwide medically and legally as the biological state of death of the organism. Nevertheless, the literature has described persistent problems with this acceptance ever since brain death was described. Many of these problems are not widely known or properly understood by much of the medical community. Here we aim to clarify these issues, based on the two intractable problems in the brain death debates. First, the metaphysical problem: there is no reason that withstands critical scrutiny (...) to believe that BD is the state of biological death of the human organism. Second, the epistemic problem: there is no way currently to diagnose the state of BD, the irreversible loss of all brain functions, using clinical tests and ancillary tests, given potential confounders to testing. We discuss these problems and their main objections and conclude that these problems are intractable in that there has been no acceptable solution offered other than bare assertions of an ‘operational definition’ of death. We present possible ways to move forward that accept both the metaphysical problem - that BD is not biological death of the human organism - and the epistemic problem - that as currently diagnosed, BD is a devastating neurological state where recovery of sentience is very unlikely, but not a confirmed state of irreversible loss of all [critical] brain functions. We argue that the best solution is to abandon the dead donor rule, thus allowing vital organ donation from patients currently diagnosed as BD, assuming appropriate changes are made to the consent process and to laws about killing.
